1. Introduction

Welcome to RoofAware (“RoofAware,” “we,” “us,” or “our”). These Terms & Conditions (the “Terms”) govern your access to and use of our websites, forms, landing pages, emails, and any services we provide (collectively, the “Services”). By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Services.

2. What RoofAware Is

RoofAware is a community awareness initiative focused on homeowner education. We help you understand roof health, identify potential issues, and connect with independent, vetted local partners for inspections or estimates upon request. Our goal is to make informed decisions easier for homeowners.

3. What RoofAware Is Not

  • RoofAware is not a roofing contractor and does not perform repair, maintenance, or installation work.
  • RoofAware does not provide professional engineering, legal, insurance, or financial advice. Any guidance is informational only.
  • Any work you choose to pursue with a partner is a separate agreement between you and that contractor.

4. Eligibility & Acceptable Use

You must be at least 18 years old and capable of entering into a binding agreement to use the Services. You agree to use the Services only for lawful purposes and in accordance with these Terms.

By submitting a form or otherwise providing your contact information, you consent to receive calls, texts, and emails related to your request, including from RoofAware and independent partners we connect you with. Message and data rates may apply. You can opt out of marketing messages at any time, but we may still send transactional messages regarding active requests.

6. Your Responsibilities

  • Provide accurate, current, and complete information.
  • Respond to scheduling messages promptly so partners can confirm appointments.
  • Do not misuse the Services (e.g., submit false requests, harass staff/partners, or attempt to interfere with the website).

7. Partners & Scheduling

When you request an evaluation, RoofAware may coordinate with an independent local partner to contact you and schedule a visit. RoofAware does not control partner pricing, timelines, workmanship, warranties, or insurance. Always review any partner’s credentials and terms before authorizing work.

8. User Content

If you submit comments, reviews, images, or other materials (“User Content”), you grant RoofAware a non‑exclusive, worldwide, royalty‑free license to use, reproduce, modify, and display such User Content for operating and improving the Services, subject to our Privacy Policy.

9. Prohibited Uses

You agree not to: (a) violate any law; (b) infringe others’ rights; (c) upload malware or attempt to disrupt the Services; (d) scrape or harvest data without consent; or (e) misrepresent your identity or affiliation.

10. Third‑Party Links & Resources

The Services may contain links to third‑party websites or resources. RoofAware is not responsible for their content, policies, or availability. Access them at your own risk.

11. Disclaimers

THE SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. ROOFAWARE MAKES NO WARRANTIES OR REPRESENTATIONS, EXPRESS OR IMPLIED, INCLUDING ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON‑INFRINGEMENT. INFORMATION PROVIDED BY ROOFAWARE IS GENERAL AND EDUCATIONAL; IT IS NOT A SUBSTITUTE FOR PROFESSIONAL INSPECTION OR ADVICE.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ROOFAWARE AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR DATA, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES OR ANY WORK PERFORMED BY INDEPENDENT PARTNERS.

13. Indemnification

You agree to indemnify, defend, and hold harmless RoofAware from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Services, your User Content, or your violation of these Terms.

14. Changes to the Terms

We may update these Terms from time to time. If we make material changes, we will post the updated Terms and update the “Last updated” date above. Continued use of the Services after changes take effect constitutes acceptance.

15. Governing Law; Disputes

These Terms are governed by the laws of the State of California, without regard to conflict of law principles. You agree to the exclusive jurisdiction of the state and federal courts located in San Diego County, California for any dispute arising from or relating to these Terms or the Services.
